COVERING LETTER FOR CHARGE FROM CLUB

Dear Sir,

I refer to your letter to Mr. Stephens dated 01/10/99.

I have to advise you that the "charges"(sic) will not be considered as they have not been drafted correctly.

I have explained to Mr. Stephens that he may only attend a properly constituted disciplinary hearing on receiving a correctly drafted charge together with a copy of the statement by the person making the charge.

These documents should be sent to me at least seven days prior to the hearing so that I may prepare his case.

Please advise me as to whether I may use your offices in order to obtain statements and to summon witnesses.

MY COVERING LETTER FOR SENDING WITH THE ABOVE

Dear Sir,

I spoke to Mr. Stephens after I had written the letters to you dated 05/10/99. He showed me your letter of 01/10/99 and my answer is enclosed.

It would seem that unacceptably long periods are occurring between each stage of this affair. Would this be because the agreement of the committee is required at each stage? If so, then perhaps an officer of the club could be mandated to progress the matter up to the hearing stage.

If the present anticipated time scale is realised then it will be well into 2000 before the matter is finalised. I have no doubt that none of the parties would be pleased with this.

It is imperative that I receive all documents, (including those requested in my previous letters), at least one week prior to the disciplinary hearing.

It would be remiss of me not to ask you to advise the officers acting in this matter that they should ensure that, when acting as directors of the company and/or officers of the club, that none is acting ultra vires. If this does prove to be so, then legal action will be sought to obtain damages, costs and expenses.

Mr. Stephens and I have decided that we will retain legal services. I will advise you of the contact as soon as possible.

I attach a suggested draft of the charge relating to the alleged assault against me.

On a personal note, I wish this to resolved quickly to the satisfaction of all involved. Then I can get back to my normal quiet retired life!
